1. License Grant
When you purchase our digital products, KOTANORA LTD will grant you a limited, non-exclusive, non-transferable, and revocable license to use the purchased avatar and associated files (the “Product”) solely for personal use in VRChat and other compatible virtual reality platforms.
2. Permitted Uses
Once sales begin, you will be allowed to:
- Use the Product as your avatar in VRChat and similar virtual platforms.
- Create and monetize streaming content, videos, and other media featuring the avatar, provided that the original source files are not redistributed or shared.
- Commission private edits or modifications to your personal copy of the Product for your own use.
3. Prohibited Uses
You may not:
- Resell, redistribute, share, sublicense, rent, lease, host, or publicly distribute the Product, source files, or any derivatives.
- Use the Product in connection with hate speech, harassment, illegal activities, or any activity that violates applicable laws or the terms of service of any platform.
- Reverse engineer, decompile, disassemble, or attempt to extract additional assets from the provided files.
4. Intellectual Property Rights
All rights, title, and interest in the Product, including all intellectual property rights, will remain exclusively with KOTANORA LTD. This license does not transfer ownership of the Product or any underlying assets.
5. Modifications and Derivatives
Any modifications or derivative works you create or commission will remain subject to the terms of this Agreement. You may not distribute, sell, or share modified versions of the Product.
6. Refunds
Due to the digital nature of the products, all sales will be final. Refunds will generally not be available, except at the sole discretion of KOTANORA LTD in cases of significant technical issues.
7. Updates and Compatibility
KOTANORA LTD may, at its discretion, provide minor updates or fixes after purchase. There is no guarantee of compatibility with future updates to VRChat or other platforms.
8. Disclaimer of Warranties
The Product will be provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, express or implied.
9. Limitation of Liability
To the maximum extent permitted by law, KOTANORA LTD will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Product.
10. Termination
This license will automatically terminate if you breach any of the terms of this Agreement. Upon termination, you must immediately cease all use of the Product and destroy any copies in your possession.
11. Governing Law and Jurisdiction
This Agreement will be governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
